Welcome to the Relocation Horizons web sites (the 'Web Site'). Please read these Terms of Use before using the services provided by Relocation Horizons both on the Web Site and off line. IF THESE TERMS OF USE ARE NOT ACCEPTABLE TO YOU, DO NOT USE THE WEB SITE OR THE SERVICES. These Terms of Use govern your use of the Web Site and Relocation Horizons's services, whether such services are provided online or off line through Relocation Horizons's call center and Personal Relocation Manager. Please note that Relocation Horizons may alter, modify or revise these Terms of Use from time to time without notice to you, and your use of the Web Site and/or the services after such change shall constitute your acceptance of the changes.

I. USE OF THE WEB SITE AND SERVICES

The Web Site and services are provided to you for your personal, non-commercial use. You may not use the services or any of the information, content or services on the Web Site for any commercial purpose or for the benefit of third parties. If you represent a corporation or entity that would like to use the Web Site or Relocation Horizons's services for commercial purposes, please contact Relocation Horizons directly to discuss a formal services agreement.

II. CONTENT AND INFORMATION

The Web Site contains content and information originated by Relocation Horizons as well as information from third parties and/or links to third party web sites (the 'Content'). Relocation Horizons does not guarantee the accuracy or correctness of the Content contained on or accessed through the Web Site. With respect to Content provided by third parties, such content is not under Relocation Horizons's control and Relocation Horizons is not responsible for such Content or any links therein. Any reliance upon the Content shall be at your sole risk and you are responsible for confirming the accuracy or correctness of the Content.

III. THIRD PARTY SERVICE PROVIDERS

Through the Web Site and off line, Relocation Horizons may suggest third party service providers, such as real estate brokers, mortgage providers, van lines and inspection companies. You are not obligated to use the third party service providers suggested by Relocation Horizons.

While Relocation Horizons will assist you in working with these third party service providers, Relocation Horizons is not taking the place of such service providers and is not responsible for the performance of such service providers. By using the Web Site and the Relocation Horizons services, you acknowledge and agree that Relocation Horizons is not acting as your real estate broker, mortgage broker, mortgage lender, inspector, appraiser, van line, storage company or other service provider. You further acknowledge and agree Relocation Horizons is not and shall not be responsible for the acts or omissions of the third party service providers. You hereby release Relocation Horizons (and its affiliates, referral partners, agents and employees) from any and all claims, demands and damages of every kind arising out of or in any way connected with the performance of the third party service providers.

IV. DISCLAIMER OF WARRANTIES; LIMITATION OF LIABILITY

You acknowledge and agree that:

Relocation Horizons DOES NOT MAKE ANY REPRESENTATIONS OR WARRANTIES WITH RESPECT TO THE RESULTS, RELIABILITY OR ACCURACY OF THE CONTENT OR SERVICES. NO ADVICE OR INFORMATION, WHETHER ORAL OR WRITTEN, OBTAINED BY YOU FROM Relocation Horizons OR THROUGH THESE WEB SITE SHALL CREATE ANY WARRANTY NOT EXPRESSLY STATED IN THE TERMS OF USE. Relocation Horizons SPECIFICALLY DISCLAIMS ALL OTHER WARRANTIES, EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, ANY IMPLIED WARRANTY OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE WITH RESPECT TO THE WEB SITE, THE CONTENT AND THE SERVICES.

IN NO EVENT SHALL Relocation Horizons (OR ITS AFFILIATES, REFERRAL PARTNERS, AGENTS OR EMPLOYEES) BE LIABLE TO YOU FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, INCLUDING, WITHOUT LIMITATION, LOSS OF REVENUES, DATA OR PROFITS. YOU ACKNOWLEDGE THAT THE EXCLUSION AND LIMITATION OF REMEDIES PROVIDED UNDER THESE TERMS OF USE ARE NEITHER UNREASONABLE NOR UNCONSCIONABLE AND IF Relocation Horizons'S LIABILITY HAD NOT BEEN SO LIMITED, THE FEES CHARGED TO YOU BY Relocation Horizons WOULD HAVE BEEN SUBSTANTIALLY HIGHER.

V. PRIVACY POLICY

The confidentiality and privacy of your information is governed by Relocation Horizons's privacy policy, as it may change from time to time. You may review the privacy policy by clicking here.

Notwithstanding the privacy policy, in order for Relocation Horizons to assist you with the third party service providers, you hereby grant Relocation Horizons permission to distribute your information to such service providers as appropriate to enable such service providers to perform the services. Relocation Horizons also reserves the right to promote its services and the products and services of its partners through the Web Site and the MoveCoordinator.

VI. GENERAL

These Terms of Use constitute the entire understanding and agreement of the parties with respect to its subject matter, and supersedes all prior and contemporaneous understandings and agreements, whether written or oral, with respect to such subject matter. No delay or failure by either party to exercise or enforce at any time any right or provision of these Terms of Use will be considered a waiver thereof of such party's rights thereafter to exercise or enforce each and every right and provision of these Terms of Use. No single waiver will constitute a continuing or subsequent waiver. No waiver, modification or amendment of any provision of these Terms of Use will be effective unless it is in writing and signed by the parties, but it need not be supported by consideration. If any provision of these Terms of Use, or the application thereof, shall for any reason and to any extent be determined by any tribunal of competent jurisdiction to be invalid or unenforceable, the remaining provisions of these Terms of Use shall be interpreted so as best to reasonably effect the intent of the parties. The parties further agree that any such invalid or unenforceable provisions shall be deemed replaced with valid and enforceable provisions that achieve, to the extent possible, the business purposes and intent of such invalid and unenforceable provisions. A printed version of these Terms of Use and of any notice given in electronic form shall be admissible in any judicial or administrative proceedings related to these Terms of Use, the Web Site or the services to the same extent as other business documents originally generated and maintained in printed form. These Terms of Use are governed by the laws of the State of Illinois, U.S.A., without regard to the conflicts of laws. Any and all actions, suits or proceedings arising under or relating to the Terms of Use, the Web Site or the services provided by Relocation Horizons shall be submitted to the jurisdiction of the state and federal courts in the State of Illinois. You hereby consent to the exclusive jurisdiction of any such court in the State of Illinois.
